1. AGREEMENT TO TERMS
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “user”, or “member”) and the International Kundalini Yoga Teachers Association (“IKYTA”, “we”, “us”, or “our”), a program of 3HO Foundation International, governing your access to and use of the website located at https://ikyta.org/ and all related services, features, and content (collectively, the “Sites”).
By accessing or using the Sites, creating an account, or purchasing a membership, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree with these Terms, you must not access or use the Sites.
We may modify these Terms at any time. The updated version will be indicated by an updated “Last updated” date and will be effective as soon as it is accessible. Your continued use of the Sites after any changes constitutes acceptance of the revised Terms.
2. ELIGIBILITY
You must be at least 18 years of age to use the Sites and to create an account. By using the Sites, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms.
3. DESCRIPTION OF SERVICES
IKYTA provides a membership-based platform that supports Kundalini Yoga teachers worldwide. The Sites include, among other features: a public teacher directory; member profiles; teacher credential and certification records; contact forms enabling communication between members and between visitors and teachers; educational content and community resources; event listings; and the ability to purchase or renew memberships and make Gurudakshina donations.
4. USER ACCOUNTS
To access certain features, you must register for an account. When you create an account, you agree to:
- Provide true, accurate, current, and complete information.
- Maintain and promptly update your information to keep it accurate and complete.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
You are responsible for safeguarding your password. IKYTA cannot and will not be liable for any loss or damage arising from your failure to maintain the security of your account.
5. TEACHER CREDENTIALS AND DIRECTORY LISTINGS
If you represent yourself as a certified Kundalini Yoga teacher, you agree that all credential information you provide — including your KRI ID, certification levels, training history, and related records — is true and accurate. Misrepresentation of certification status or use of false credentials is a material breach of these Terms and may result in immediate suspension or termination of your account.
Certification records you submit may be reviewed and verified by IKYTA before they appear on your public profile. You are solely responsible for the accuracy of the information displayed on your profile and directory listing.
You control whether and how your profile appears in the public directory through your profile settings, as described in our Privacy Policy.
6. ACCEPTABLE USE
You agree not to use the Sites to:
- Violate any applicable law or regulation.
- Impersonate any person or entity, or misrepresent your affiliation or credentials.
- Send spam, chain communications, or unsolicited commercial messages through the contact forms or any other feature.
- Harass, abuse, threaten, or harm another person.
- Upload or transmit viruses, malware, or any other malicious code.
- Attempt to gain unauthorized access to the Sites, other accounts, or our systems.
- Collect, harvest, or scrape personal information of other users.
- Use the contact features for any purpose other than legitimate, good-faith communication.
- Interfere with or disrupt the integrity or performance of the Sites.
Violation of this section may result in immediate suspension or termination of your account without notice.
7. COMMUNICATION FEATURES
The Sites provide contact forms that allow members to communicate with one another and that allow visitors to contact teachers. You are solely responsible for the content of the messages you send. IKYTA does not monitor and is not responsible for the content of communications between users, but reserves the right to review, remove, or take action regarding any communication that violates these Terms.
If you receive abusive, harassing, fraudulent, or otherwise inappropriate messages, please report them to [email protected].
8. MEMBERSHIP, FEES, AND PAYMENTS
IKYTA offers memberships available on a monthly and annual basis, as well as the ability to make Gurudakshina donations. The applicable fees, billing frequency, and currency are presented to you at the time of purchase.
8.1. Payment Processing
Payments are processed by our third-party payment providers, Stripe and PayPal. By providing payment information, you authorize us and our payment providers to charge the applicable fees. IKYTA does not store your full payment card information on its servers.
8.2. Automatic Renewal
MEMBERSHIPS RENEW AUTOMATICALLY. Unless you cancel before the end of your current membership term, your membership will automatically renew, and the payment method on file will be charged the then-current membership fee for the next term (monthly or annual, as applicable). We will disclose the auto-renewal terms to you at the time of purchase.
You may turn off automatic renewal or cancel your membership at any time through your account settings (“My Subscription”) or by contacting us at [email protected]. If you cancel, your membership will remain active until the end of the current paid term, and it will not renew thereafter. Where required by applicable law, we will provide advance notice before a renewal charge.
8.3. Refunds
Refunds are considered on a case-by-case basis at IKYTA’s discretion, except where a refund is required by applicable law. Residents of the European Union and other jurisdictions with mandatory consumer-protection rights may be entitled to a statutory right of withdrawal (for example, a 14-day cancellation period for certain purchases). Gurudakshina donations are voluntary contributions and are generally non-refundable. To request a refund, contact us at [email protected].
8.4. Price Changes
We may change membership fees from time to time. Any price change will apply to the next billing cycle after the change, and, where required by law, we will provide you with advance notice and the opportunity to cancel before the new price takes effect.
9. ACCOUNT INACTIVITY AND TERMINATION
IKYTA reserves the right to delete user accounts that have remained inactive for a period of 6 (six) months or more. An account is considered “inactive” when the user has not logged in, renewed their membership, or otherwise interacted with IKYTA’s services during the relevant period. Before deleting an inactive account, IKYTA will notify the user by email with at least 30 (thirty) days’ advance notice and the opportunity to keep the account active.
In addition, IKYTA reserves the right to suspend or terminate your account immediately and without prior notice if: (a) you breach these Terms or the Privacy Policy; (b) you engage in fraudulent activity or misrepresentation; (c) you use false or unauthorized credentials, including misrepresentation of KRI certification status; (d) you abuse the communication features; (e) your conduct endangers or harms other users or the IKYTA community; (f) required by competent legal or regulatory authorities; or (g) for any other reason IKYTA, in its sole discretion, determines necessary to protect its interests, its users, or the integrity of the Sites.
You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Sites will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.
10. INTELLECTUAL PROPERTY
The Sites and their original content, features, and functionality — including text, graphics, logos, and software — are owned by IKYTA, 3HO Foundation International, or their licensors and are protected by intellectual property laws. “Sat Nam Rasayan®” and other marks displayed on the Sites are the property of their respective owners.
You retain ownership of the content you submit to your profile (such as your biography, photos, and links). By submitting content, you grant IKYTA a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content for the purpose of operating and promoting the Sites and the teacher directory. You represent that you have the rights necessary to grant this license.
11. DISCLAIMERS
THE SITES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IKYTA DOES NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
IKYTA does not verify the identity of all users and does not guarantee the accuracy of any teacher’s credentials, listings, or communications beyond the verification processes it chooses to apply. Your interactions with other users are at your own risk.
Nothing on the Sites constitutes medical advice. Kundalini Yoga practices are undertaken at your own risk; consult a qualified healthcare provider before beginning any exercise or wellness practice.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IKYTA, 3HO FOUNDATION INTERNATIONAL, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITES. IKYTA’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITES SHALL NOT EXCEED THE AMOUNT YOU PAID TO IKYTA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. INDEMNIFICATION
You agree to indemnify and hold harmless IKYTA, 3HO Foundation International, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Sites, your violation of these Terms, or your violation of any rights of a third party.
14. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Sites shall be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico, United States, except where applicable mandatory consumer-protection laws of your country of residence provide otherwise.
15. MISCELLANEOUS
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be considered a waiver of those rights. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and IKYTA regarding the Sites.
